DISTANCE SELLING AGREEMENT

ARTICLE 1 – THE PARTIES

ARTICLE 2 – SUBJECT MATTER

The subject matter of this agreement is to determine the rights and obligations of the parties regarding the sale and delivery of the product specified below, including its characteristics and sales price, which the BUYER has ordered electronically from the internet shopping site ‘alcaline.extant.com.tr’ belonging to the SELLER.

ARTICLE 3 – PAYMENT

3.1. Payment Method: Payment by Bank Transfer / EFT

Credit Card Refund Procedure:

The Bank will refund the customer in instalments corresponding to the number of instalments used to purchase the product. After suaritma.extant.com.tr pays the full price of the product to the bank in a single payment, if the instalment payments made via the bank’s POS terminals are refunded to the customer’s credit card, the requested refund amounts are transferred by the bank to the accounts of the parties involved in instalments so that the parties involved are not disadvantaged. The instalment amounts paid by the customer up to the cancellation of the sale will be reflected as one refund per month on the card, provided that the refund date does not coincide with the card’s billing date. After the sale instalments have been completed, the customer will receive the number of months equal to the number of instalments paid before the refund and these will be deducted from their current debts.

In the event of a refund for goods and services purchased with a card, suaritma.extant.com.tr cannot make a cash payment to the Customer in accordance with its agreement with the Bank. The member business, i.e. alcaline.extant.com.tr, will process the refund via the relevant software when a refund is requested. As the member business, i.e. alcaline.extant.com.tr, is obliged to pay the relevant amount to the Bank in cash or by offset, the Customer cannot be paid in cash in accordance with the procedure described above. Refunds to credit cards will be made by the bank in accordance with the above procedure after suaritma.extant.com.tr pays the amount to the bank in a single instalment.

The recipient acknowledges and undertakes that they have read and accepted this procedure.

Delivery will be made by hand to the Buyer at the address specified above via a courier company. Even if the Buyer is not present at the address at the time of delivery, the Seller shall be deemed to have fulfilled its obligation in full and without defect. Therefore, any damages arising from the Buyer receiving the product late, as well as any costs incurred due to the product being held by the courier company and/or the shipment being returned to the Seller, shall be borne by the Buyer.

ARTICLE 4 – GENERAL PROVISIONS

4.1. The product subject to the contract shall be delivered to the BUYER or to the person/organisation at the address indicated by the BUYER within the period specified in the preliminary information on the website for each product, depending on the distance from the BUYER’s place of residence, provided that this period does not exceed the statutory 30–day period.

4.2. If the product subject to the contract is to be delivered to a person/organisation other than the BUYER, the SELLER cannot be held responsible if the person/organisation to whom it is delivered refuses to accept it.

4.3. The SELLER is responsible for delivering the product subject to the contract in a sound and complete condition, in accordance with the specifications stated in the order and, where applicable, with the warranty certificates and user manuals.

4.4. Delivery of the product covered by this contract is conditional upon the signed copy of this contract being delivered to the SELLER and the price being paid by the BUYER using their preferred payment method. If, for any reason, the product price is not paid or is cancelled in the bank records, the SELLER shall be deemed to be released from their obligation to deliver the product.

4.5. Following delivery of the product, if the bank or financial institution fails to pay the product price to the SELLER due to unauthorised, unjust or unlawful use of the BUYER’s credit card by unauthorised persons through no fault of the BUYER, the product must be returned to the SELLER within 3 days, provided that it has been delivered to the BUYER. In this case, the shipping costs shall be borne by the BUYER.

4.6. Products sold with or without a warranty certificate that are faulty or defective (defective) may be sent to the SELLER for the necessary repairs to be carried out by an authorised service centre under the warranty terms; in this case, the shipping costs shall be borne by the SELLER.

ARTICLE 5 – RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw from the contract within 7 days of delivery of the product to themselves or to the person/organisation at the address indicated. In order to exercise this right of withdrawal, notification must be made to the SELLER by fax, email or telephone within this period, provided that the product has not been used. If this right is exercised, the original invoice and a copy of the delivery note confirming that the product delivered to a third party or the BUYER has been sent to the SELLER must be returned. The product price shall be refunded to the BUYER within 7 days of receipt of these documents.

ARTICLE 6 – PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal cannot be exercised for products that cannot be returned due to their nature, single–use products, or products that have passed their expiry date. The exercise of the right of withdrawal for the following products is subject to the condition that the product packaging is unopened, undamaged, and the product is unused.

– Products that cannot be returned due to their nature (except in cases where the product is faulty or defective, products that may pose a health risk after opening, e.g. products that require direct contact with the body during use (), single-use products, products that spoil quickly or have passed their expiry date, and cannot be returned.

ARTICLE 7 – DEFAULT PROVISIONS

This shall apply in the event that the parties fail to fulfil their obligations arising from this agreement. In the event of default, if either party fails to fulfil its obligations within the specified time without a valid reason, the other party shall grant the defaulting party a period of seven days to fulfil the obligation in question. If the obligation is still not fulfilled within this period, the defaulting party shall be deemed to be in default, and the creditor shall have the right to demand performance of the obligation, delivery of the goods, and/or termination of the agreement and refund of the price.

Regarding Distance Contracts, ‘alcaline.extant.com.tr’ undertakes to notify the consumer of any impossibility to fulfil its contractual obligations arising from the contract (i.e., the situation where the product cannot be supplied by the supplier company under any circumstances) before the performance period stipulated in the contract expires. In this case, suaritma.extant.com.tr reserves the right to terminate the contract immediately and undertakes to refund the customer the price of the product ordered and any documents that may have incurred debt.

If force majeure events or adverse weather conditions preventing transport, disruption of transport, fire, earthquake, flood or other extraordinary events prevent ‘alcaline.extant.com.tr’ from fulfilling this obligation and the product subject to the contract cannot be delivered within the specified time, in such cases the Buyer may exercise one of the following rights: request cancellation of the order or postponement of delivery until the impediment ceases. extant.com.tr” shall bear no responsibility, and the Buyer may exercise the right to cancel the order or postpone delivery until the impediment ceases. If the Buyer cancels the order, the amount paid shall be refunded within 10 days. (For instalment purchases made by credit card, the above procedure for credit card refunds is accepted by the Buyer).
